NOTICE OF ELECTION

 

TO THE RESIDENT QUALIFIED ELECTORS OF

BUNA INDEPENDENT SCHOOL DISTRICT

 

TAKE NOTICE that an election will be held in the Buna Independent School District on August 16, 2016, in obedience to an order duly entered by the Board of Trustees of the District on June 20, 2016, which order reads substantially as follows:

 

ORDER CALLING A TAX RATIFICATION ELECTION TO BE HELD BY THE BUNA INDEPENDENT SCHOOL DISTRICT, MAKING PROVISION FOR THE CONDUCT OF THE ELECTION, AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH ELECTION

BUNA INDEPENDENT SCHOOL DISTRICT §

 

WHEREAS, the Board of Trustees of the Buna Independent School District (the “District”) hereby finds that it is necessary and advisable to call and hold a tax ratification election under the provisions of the Texas Tax Code, Chapter 26, as amended; and

 

WHEREAS, the meeting of this Board of Trustees at which this Order was adopted was open to the public and public notice of the date, time, place and purpose of said meeting was given, all as required by Chapter 551 of the Texas Government Code.

 

THEREFORE, BE IT ORDERED BY THE BOARD OF TRUSTEES OF BUNA INDEPENDENT SCHOOL DISTRICT THAT:

 

1. An election shall be held on the 16th day of August, 2016, in the Buna Independent School District, which date is not less than thirty (30) days nor later than ninety (90) days from the date on which the District adopted its tax rate for Fiscal Year 2016, for the purpose of submitting the following measure and proposition to the qualified voters of the District in accordance with law:

 

Shall the Board of Trustees of the Buna Independent School District be authorized to levy, pursuant to an order of such Board adopted on June 20, 2016, an ad valorem tax rate of $1.17 for Maintenance and Operations and $0.32 for Debt Service, for a total tax rate of $1.49 per $100.00 of the taxable assessed valuation of property within the Buna Independent School District beginning with the 2016 tax year, being a rate that is $0.00 higher per $100.00 of such taxable assessed valuation than the school district rollback tax for such year, calculated pursuant to Section 26.08, as amended, Texas Tax Code, for the purpose of increasing the state funding received by the District?

 

2. The election shall be held, and notice is hereby given that an election will be held, between the hours of 7:00 a.m. and 7:00 p.m. on August 16, 2016, in the Buna Independent School District, for the purpose stated herein, at the following designated polling place within the District:

 

BUNA I.S.D. CENTRAL ADMINISTRATION BUILDING

1022 Highway 62

Buna, Texas 77612

 

Said polling place shall constitute a single election precinct for said election.

 

2. The following election officers are hereby appointed to hold said election:

 

PRESIDING JUDGE: Penny Martin

 

ALTERNATE PRESIDING JUDGE: Carla Walker

 

The Presiding Judge shall appoint not less than two qualified election clerks to serve and assist in conducting said election; provided that if the Presiding Judge actually serves as the Presiding Judge, the Alternate Presiding Judge shall be one of such clerks.  In the absence of the Presiding Judge, the Alternate Presiding Judge shall perform the duties of the Presiding Judge in the election precinct.

 

3. Early voting by personal appearance shall be conducted from August 1, 2016, through August 12, 2016, inclusive.  The Central Administration Office of the Buna Independent School District, 1022 Highway 62, Buna, Texas 77612, which is a public place within the District, is hereby designated as the main early voting place where early voting by personal appearance shall be conducted.  The early voting clerk and Presiding Judge shall be Penny Martin, whose business address is 1022 Highway 62,  Buna, Texas 77612, and whose email address is pemartin@bunaisd.net.  Cathy Burt, Cristi Fountain, Brenda Morgan and Carla Walker are hereby appointed as deputy early voting clerks.  Such office or place of early voting by personal appearance shall be open from 8:00 a.m. until 4:00 p.m. on each day for voting which is not a Saturday, a Sunday or an official state holiday.  

 

4. The Central Administration Building of the Buna Independent School District, 1022 Highway 62,  Buna, Texas 77612, shall be the voting place for all early voting by mail.  The Presiding Judge for early voting by mail shall be Penny Martin, whose mailing address is Buna Independent School District, PO Box 1087, Buna, Texas 77612, to which all ballot applications and early voting ballots shall be sent.  Early voting by mail shall be conducted during the same period as early voting by personal appearance, except that envelopes containing mailed ballots must arrive at the address on the carrier envelope before the polls are required to close on Election Day, unless otherwise determined to be timely pursuant to Article 86.007, Texas Election Code.

 

5. The conduct and manner in which said election shall be conducted shall be governed by and in accordance with the Texas Education Code, the Texas Election Code, the Voting Rights Act Amendments of 1975, and the rules of the Department of Justice.

 

6. An Early Voting Ballot Board is hereby created for the purpose of processing early voting results and shall consist Penny Martin, whose address is 723 County Road 740 Buna Texas 77612 as Presiding Judge, and two other qualified members to be appointed by Penny Martin, in accordance with Article 87.001, et seq. of the Texas Election Code.

 

7. Penny Martin, a duly qualified person, is hereby appointed to serve as Presiding Judge, Central Counting Station, and he shall perform the duties and assume the responsibilities inherent in that office.  The manner in which said election shall be conducted shall be governed by the Texas Education Code and the Texas Election Code and this Board of Trustees will furnish all necessary ballots and other election supplies requisite to said election.

 

8. All resident, qualified electors of the Buna Independent School District shall be entitled to vote at said election, and, on the day of the election, such electors are to vote at the designated polling place.

 

9. Pursuant to Section 61.012, as amended, Texas Election Code, the District shall provide at least one accessible voting system in each polling place used in the Election.  Such voting system shall comply with the Texas and federal laws establishing the requirement for voting systems that permit voters with physical disabilities to cast a secret ballot.  

 

10. A substantial copy of this Order shall serve as proper Notice of said election and the President of the Board of Trustees shall cause said Notice to be published in English and Spanish one time, not earlier than the 30th day or later than the 10th day prior to the date set for the election in a newspaper published in and of general circulation in said District, and the President of the Board of Trustees shall also cause this Order to be posted where notices are customarily posted in the Buna Independent School District and also posted on the District’s website at least twenty-one (21) days before the date of the election.

 

11. The official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid Proposition with the ballots to contain such provisions, markings and language as required by law and with such Proposition to be expressed substantially as follows:

 

PROPOSITION

 

APPROVING THE AD VALOREM TAX RATE OF $1.49 PER $100

VALUATION IN THE BUNA INDEPENDENT SCHOOL DISTRICT

FOR THE CURRENT YEAR, A RATE THAT IS $0.00 HIGHER PER

$100 VALUATION THAN THE SCHOOL DISTRICT ROLLBACK

TAX RATE, FOR THE PURPOSE OF INCREASING STATE FUNDING RECEIVED BY THE DISTRICT

 

12. In all respects, said election shall be conducted in accordance with the Texas Election Code.

 

13. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Order for all purposes and are adopted as a part of the judgment and findings of the Board of Trustees of the District.

 

14. All orders and resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Order are hereby repealed to the extent of such conflict, and the provisions of this Order are and remain controlling as to the matters ordered herein.

 

15. This Order shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America.

 

16. If any provision of this Order or the application thereof to any person or circumstance is held to be invalid, the remainder of this Order and the application of such provision to other persons and circumstances is nevertheless be valid, and this Board of Trustees hereby declares that this Order would have been enacted without such invalid provision.

 

17. It is officially found, determined, and declared that the meeting at which the Order is adopted was open to the public and public notice of the time, place and subject matter of the public business to be considered at such meeting, including this Order, was given, all as required by Texas Government Code chapter 551, as amended.

 

18. This Order is in force and effect from and after its final passage, and it is so ordered.

 

19. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Order for all purposes and are adopted as a part of the judgment and findings of the Board of Trustees of the District.

 

20. To the extent permitted by law, the Board authorizes the President of the Board of Trustees, the Superintendent, or the respective designees thereof, to negotiate, enter into on the District’s behalf and execute any necessary election agreements and make such technical modifications to this Order, and to make changes to polling places, election judges and officers, that are necessary for compliance with applicable Texas or federal law or to carry out the intent of the Board, as evidenced herein.

PARA LOS VOTANTES CALIFICADOS RESIDENTES DEL

DISTRITO ESCOLAR INDEPENDIENTE DE BUNA

 

TOME AVISO que se llevará a cabo una elección en el Distrito Escolar Independiente de Buna el 16 de agosto, del 2016, obedeciendo la orden debidamente presentada por el Consejo de Administración del Distrito el 20 de junio, del 2016, cuya orden es del tenor siguiente:

 

ORDEN DE CONVOCATORIA DE UNAS ELECCIONES RATIFICACIÓN DE IMPUESTOS QUE SE REALIZARÁ POR EL DISTRITO ESCOLAR INDEPENDIENTE BUNA, TENIENDO EN CUENTA A LA REALIZACIÓN DE LAS ELECCIONES, Y LA RESOLUCIÓN DE OTROS ASUNTOS RELACIONADOS CON INCIDENTES Y DICHA ELECCIÓN

DISTRITO ESCOLAR INDEPENDIENTE DE BUNA §

 

Considerando, al Consejo de Administración del Distrito Escolar Independiente de Buna (el "Distrito") por este acto determina que es necesario y aconsejable convocar y realizar una elección ratificación de impuestos bajo las disposiciones del Código de Impuestos de Texas, Capítulo 26, forma enmendada; y

 

CONSIDERANDO, la reunión de este Consejo de Administración en la cual esta Orden fue adoptada estuvo abierta al público y se dio un aviso público de la fecha, hora, lugar y propósito de dicha reunión, todo según lo requerido por el Capítulo 551 del Código de Gobierno de Texas.

 

POR LO TANTO, SE PIDE MEDIANTE EL CONSEJO DE ADMINISTRACIÓN DEL DISTRITO ESCOLAR INDEPENDIENTE DE BUNA QUE:

 

1. Una elección se llevará a cabo en el día 16 del de agosto de, 2016, del Distrito Escolar Independiente de Buna, que la fecha es no menor de treinta (30) días ni más tarde de noventa (90) días desde la fecha en que el Distrito ha adoptado su impuesto tarifa para el año fiscal 2016, con el propósito de presentar la siguiente medida y proposición a los votantes calificados del Distrito de acuerdo con la ley:

 

Será la Junta Directiva del Distrito Escolar Independiente de Buna autorizado a aplicar, conformidad con la orden de dicha Junta aprobó el 20 de junio de 2016, un tipo ad valorem de $ 1.17 Mantenimiento y Operaciones y $ 0,32 Servicio de la deuda, para un total tasa de impuesto de $ 1.49 por cada $ 100.00 del la valoración imponible de tasación de la propiedad dentro del distrito escolar independiente de Buna comenzando con el año fiscal 2016, siendo una tasa que es $ 0.00 más alto por $ 100.00 de dicha valuación fiscal imponible que el impuesto retroactivo distrito escolar para dicho año, calculado conforme a la Sección 26.08, forma enmendada, Código de Impuestos de Texas, con el propósito de aumentar la financiación estatal recibida por el Distrito?

 

2. La elección se llevará a cabo, y se hace constar que una elección se llevará a cabo, entre las horas de 7:00 am y 7:00 pm el 16 de agosto de 2016, en el distrito escolar independiente de Buna, para el propósito indicado en el presente documento, en el siguiente lugar de votación designado dentro del Distrito:

 

BUNA I.S.D. CENTRAL ADMINISTRATION BUILDING

1022 Highway 62

Buna, Texas 77612

 

Dicho lugar de votación constituirá un solo distrito electoral para dicha elección.

 

2. Los siguientes oficiales de la elección Se nombra para sostener dicha elección:

 

JUEZ PRESIDENTE: Penny Martin

 

JUEZ PRESIDENTE ALTERNO: Carla Walker

 

El Juez Presidente designará no menos de dos secretarios electorales cualificados para servir y ayudar en la realización de dicha elección; a condición de que si el Juez Presidente ejerza sus funciones como al Juez Presidente, el Juez presidente alterno será uno de dichos secretarios. En ausencia del Juez Presidente, el Juez Presidente Alterno ejercerá las funciones del presidente del tribunal en el precinto electoral.

 

3. La votación anticipada en persona se llevará a cabo del 1 de agosto, 2016, hasta el 12 de agosto de, 2016, ambos inclusive. La Oficina de Administración central del distrito escolar independiente de Buna, 1022 Highway 62, Buna, Texas 77612, que es un lugar público dentro del Distrito, queda designado como el lugar de votación anticipada principal, donde se llevará a cabo la votación anticipada en persona. El encargado de la votación temprana y Juez Presidente serán Penny Martin, con domicilio social en 1022 Highway 62, Buna, Texas 77612, y cuya dirección de correo electrónico está pemartin@bunaisd.net. Cathy Burt, Cristi Fuente, Brenda Morgan y Carla Walker Se nombra secretarios delegados de votación temprana. Dicha oficina o lugar de votación anticipada en persona estarán abiertas desde las 8 a.m. hasta las 4:00 p.m. cada día de la votación, que no sea sábado, domingo o un feriado oficial del estado.  

 

4. El edificio de la administración central del distrito escolar independiente de Buna, 1022 Highway 62, Buna, Texas 77612, será el lugar de votación para todos votación anticipada por correo. El Juez Presidente para la votación anticipada por correo se someterá a Penny Martin, cuya dirección de correo es distrito escolar independiente de Buna, PO Box 1087, Buna, Texas 77612, a la que todas las aplicaciones y papeletas de votación anticipada se enviarán. La votación anticipada por correo se llevará a cabo durante el mismo período que la votación anticipada en persona, a excepción de que los sobres que contienen las papeletas enviadas por correo deberán llegar a la dirección en el sobre de envío antes de que se requieren las urnas para cerrar el día de elección, a menos que se determinó que era oportuna conformidad con el artículo 86.007, Código de Elecciones de Texas.

 

5. La conducta y la manera en que dicha elección se llevará a cabo se regirá por y de acuerdo con el Código de Educación de Texas, el Código de Elecciones de Texas, las modificaciones de la Ley de Derecho al Voto de 1975 y las normas del Departamento de Justicia.

 

6. Una Junta de Votación anticipada Se crea con el propósito de los resultados de tramitación anticipada de voto y estará compuesto por Penny Martin, cuya dirección es 723 County Road 740 Buna Tejas 77612 como Juez Presidente y otros dos miembros calificados para ser nombrado por Penny Martin, de conformidad con el artículo 87.001, y siguientes del Código de Elecciones de Texas.

 

7. Penny Martin, una persona calificada debidamente, se nombra para servir como Juez Presidente, Estación Central de Conteo, y desempeñará las funciones y asumir las responsabilidades inherentes a dicho cargo. La manera en que dicha elección se llevará a cabo, se regirá por el Código de Educación de Texas y el Código Electoral de Texas y esto Patronato suministrará todos los votos necesarios y otros suministros electorales necesarias para dicha elección.

 

8. Todos los residentes, electores calificados del Distrito Escolar Independiente de Buna tendrá derecho a votar en dicha elección, y, en el día de la elección, tales electores han de votar en el lugar de votación designado.

 

9. De conformidad con la Sección 61.012, según enmendada, Código de Elecciones de Texas, el Distrito deberá proporcionar por lo menos un sistema de votación accesible en cada lugar de votación utilizado en la elección. Dicho sistema de votación deberá cumplir con las leyes de Texas y federales que se establece el requisito de sistemas de votación para permitirles a los votantes con discapacidades físicas que emitan un voto secreto.  

 

10. Una copia sustancial de esta Orden servirá como Aviso apropiado de dicha elección y el Presidente del Consejo de administración hará que dicho Aviso se publique en Inglés y Español una vez, no antes de los 30 días o más tarde de los 10 días antes de la la fecha fijada para la elección de un periódico publicado en y de circulación general en dicho distrito, y el Presidente de la Junta Directiva serán también causar esta Orden para ser publicado en los anuncios se acostumbra destinado en el distrito escolar independiente de Buna y también publicados en sitio de la red al menos veintiún (21) días antes de la fecha de la elección.

 

11. Las boletas oficiales para dicha elección deberán ser preparadas de acuerdo con el Código Electoral de Texas con el fin de permitir a los electores votar "A FAVOR" o "EN CONTRA" de la propuesta antes mencionada y con las papeletas para contener tales disposiciones, marcas y lenguaje como requiere la ley y con tal proposición es expresado sustancialmente como sigue:


 

PROPOSICIÓN

 

SE APRUEBA LA TASA AD VALOREM DE $ 1.49 POR $ 100 DE VALORACIÓN EN EL DISTRITO ESCOLAR INDEPENDIENTE BUNA PARA EL AÑO EN CURSO, UNA TASA QUE ES $ 0.00 MÁS ALTO POR $ 100 DEL VALOR DE LA TASA DE IMPUESTO RETROACTIVO DISTRITO ESCOLAR, CON EL FIN DE AUMENTAR LA FINANCIACIÓN ESTATAL RECIBIDA POR EL DISTRITO

 

12. En todos los aspectos, dicha elección se llevará a cabo de conformidad con el Código de Elecciones de Texas.

 

13. Los considerandos contenidos en el preámbulo del presente documento se encuentran la presente para ser verdad, y tales considerandos quedan hechos una parte de la presente Resolución a todos los efectos y se adoptan como parte de la sentencia y conclusiones de la Junta de Directiva del Distrito.

 

14. Todas las órdenes y resoluciones, o partes de los mismos, que están en conflicto o incompatibles con cualquier disposición de la presente Orden quedan derogadas en la medida de dicho conflicto, y las disposiciones de la presente Orden son y permanecerán vigentes con respecto a las materias ordenadas en la presente.

 

15. La presente Orden será interpretada y ejecutada de acuerdo con las leyes del estado de Texas y los Estados Unidos de América.

 

16. Si alguna disposición de esta Orden o su aplicación a cualquier persona o circunstancia se considera inválida, el resto de esta Orden y de la aplicación de dicha disposición a otras personas o circunstancias, no obstante, ser válido, y esta Junta Directiva declara que esta orden habría sido aprobada sin dicha disposición inválida.

 

17. Se encuentra oficialmente, determinado, y declaró que la reunión en que se adoptó la Orden estuvo abierta al aviso público y público de la hora, el lugar y el objeto de la empresa pública para ser considerado en tal reunión, incluyendo la presente Orden, se dado, según lo exige el Código de Gobierno de Texas capítulo 551, forma enmendada.

 

18. Esta orden está en vigor y efecto desde y después de su aprobación final, y así se ordenó.

 

19. Los considerandos contenidos en el preámbulo del presente documento se encuentran la presente para ser verdad, y tales considerandos quedan hechos una parte de la presente Resolución a todos los efectos y se adoptan como parte de la sentencia y conclusiones de la Junta de Directiva del Distrito.

 

20. En la medida permitida por la ley, a la Junta autoriza al Presidente de la Junta Directiva, el Superintendente, o los respectivos designados de los mismos, a negociar, celebrar en nombre del Distrito y realizar todos los actos electorales necesarias y efectuar las modificaciones técnicas a la presente Orden y para realizar cambios en los lugares de votación, los jurados de votación y oficiales, que son necesarios para el cumplimiento de de Texas o ley federal o para llevar a cabo la intención de la Junta, como se evidencia en el presente documento.
